What is a reasonable de-clamping fee on private ground?

This is very difficult as there are no Statutory Fee scale for parking on private ground. In our Legal Cases section of our secure Downloads area you will see that we have provided a Court of Appeal legal case where the Judge considered at that time(1992) that the fee charged of £40 was reasonable. In a further Court of Appeal case in 1997 (details of which are also in our Downloads area the fee paid was £105. This was broken down as to £65 for the clamping company with the authority retaining £40. As the court ordered that this amount, plus interest was to be repaid to the claimant, the court did not need to consider the matter of whether the fees were excessive or not.

However, the original trial judge in this particular case had regarded the fee to be reasonable.

As the clamping fee in London is set at £65, then any figure much in excess of this should be deemed unreasonable.
