Who are the Adjudicators?

For your case to be eligible for consideration by the adjudicators, you must first make a representation to the local authority responsible for issuing you the ticket. Only once you have received a Notice of Rejection, can you then proceed to take your case to the adjudicators.

Cases are decided by independent Adjudicators, each of whom are qualified barristers or a solicitors directly appointed by the Lord Chancellor. They decide each case impartially, applying the law to the facts of the case. There are three separate Adjudication services: they are:

PATAS (The Parking and Traffic Appeals Service) are the Parking Adjudicators who consider appeals against Penalty Charge Notices issued by all London local authorities. PATAS also provides the administrative support to the Road User Charging Adjudicators (RUCAT). In the year to March 2006, PATAS received 52,764 appeals.

NPAS (National Parking Adjudication Service) consider appeals against Penalty Charge Notices issued by 139 local authorities in England and Wales excluding London that operate decriminalised parking enforcement. They consider appeals by motorists, and also by the vehicle owners whose vehicles may have been issued with Penalty Charge Notices (or have been removed or clamped).

NPAS have recently introduced a system where you may lodge your Notice of Appeal online. This is currently a trial scheme in conjunction with a small number of councils. For further details you will need to refer to their web site.

RUCAT (The Road User Charging Adjudicators Tribunal) considers appeals against congestion charging penalties in London. RUCAT is independent from London local authorities and Transport for London. For the year ending March 2004, RUCAT received 42,339 appeals, but this figure has drastically reduced to 16,583 for the year ending March 2006. RUCAT consider that one of the reasons for this could be that TfL are now charged a fee of £28 for every appeal registered with RUCAT.

If you are considering taking a case to the Adjudicators, it is advisable to visit their website, which is extremely informative. In particular, each adjudicator features a Cases Digest that outlines important cases which could be helpful in identifying the grounds for your appeal.
