Sale of the clamped vehicle.
If your car has been clamped by the bailiff under the Clamping
Order, there are procedures that must happen before it can be sold. No earlier than 10 days after the car has been clamped, the Fines Officer must list an application
with the Magistrates Court for an “Order for Sale of Vehicle”.
This will involve a court hearing approximately 21 days following the
clamping of the vehicle. Only if the
Court makes an order for sale, will the Fines Officer send a copy
of the Order to the Contractor (bailiff) who can then arrange
for the vehicle to be sold.
Any money raised from the sale, can be first used to pay the bailiffs
charges. The remaining balance must be paid to the Fines Officer.
It is an offence to remove the immobilisation device, and this
offence carries a fine up to a maximum of £1,000. The Statutory
Regulation concerning Clamping Orders can be found in the following
link.
