Appealing a Congestion Charge
to the Adjudicators?
The Road User Charging Adjudicators Tribunal ('RUCAT') is entirely
independent from Transport for London. Their role is to decide
appeals against congestion charging penalties in London. During
the period 2005/06 they received 48,277 applications for appeals
of which 28,121 were allowed, this resulted in the Congestion
Charge notices being cancelled or,
if monies had already been paid, or vehicles clamped, refunds
were given.
Cases are decided by independent Adjudicators, each of whom is
qualified either, as a barrister, or a solicitor with at least
5 years training, and who are directly appointed by the Lord Chancellor.
They decide each case impartially, applying the law to the facts
of the case.
The adjudicators have their own website which is easy to understand
and provides instructions on all of the stages of the adjudication
process to include details of key legal cases that may be relevant
to your own particular complaint and full details on the grounds
for appeal. For further information you will need to visit the
following website and follow the link to the
Road User Charging Adjudicators section.
