Bailiff Offences

Complaining about the fees.

Where to complain.

How much will the bailiff charge me?

For many bailiffs, the simple answer is….. whatever he can get away with.

Bailiff charges are the most common area of dispute. The following is just a small example:

• Fees not permitted, e.g. when no levy has been made.
• Fees that are spurious, e.g. ‘enforcement" , "attending to remove" ’ and ‘clamping’ fees.
• Charges that are unreasonable and disproportionate to the amount of the debt.
• Charging for "alledged" or "phantom" visits that did not actually take   place.
• Multiple charges for enforcing more than one Liability Order or more than     one Parking Charge Notice  at the same visit.

The most common area of complaint concerns the provision in the Statutory Regulations, for what is called “reasonable costs” for attending with a vehicle etc. It is the interpretation of what is “reasonable” that is the most difficult to determine.

In our Downloads section, you will see under the heading of Bailiff Fees that we have provided details of the amount that can be charged by bailiffs when enforcing the following debts, together with a simple explanation as to how to work out the fees.
